NEW: USCIS Resumes Premium Processing for I-129 and I-140 Petitions Beginning June 1
Beginning June 1, USCIS will reinstate premium processing in phases for various I-129 and I-140 petitions. The planned phases for accepting premium processing requests are:
All eligible I-140 petitions
CAP exempt H-1B petitions filed before June 8 that are pending
All other Form I-129 petitions (non H-1B petitions) filed before June 8 that are pending
H-1B petitions with a concurrently filed I-907 Premium Processing Request that are exempt from the cap because:
The employer is cap-exempt or because the beneficiary will be employed at a qualifying cap-exempt institution, entity or organization; or
The beneficiary is cap-exempt based on a Conrad/IGA waiver under INA section 214(l).
All H-1B cap-subject petitions
All other Form I-129 petitions filed concurrently with an I-907 Premium Processing Request
These phases are subject to change and USCIS will announce any updates to this schedule if they occur. If you have any questions or would like to discuss whether your petition will be eligible for premium processing, please contact Ayla Adomat, Esq at firstname.lastname@example.org.
