In its last months, the Trump administration is considering releasing an executive order that would eliminate US birthright citizenship.
President Trump has advocated for removing birthright citizenship throughout his presidency. Reports state that drafts of this executive order are circulating and a final version may be released before the Biden administration takes office in January 2021.
Most legal experts agree that birthright citizenship is protected in the Constitution by the Fourteenth Amendment. However, the court system has never ruled on this issue.
